Art. 51 of Decree 4000 of 2004
DURATION: Indefinite. It will be canceled in the event of absence from Colombian territory for more than two (2) years.
It may be granted to any foreigner who fulfils the following conditions:
- Any foreigner who has held a temporary visa and lived in national territory continuously for at least five (5) continuous, uninterrupted years and presents an application at the least within the thirty (30) calendar days prior to expiration of the respective visa, except in duly proven cases of force majeure and act of God.
- Foreigners who are the father or mother of a Colombian national.
- An adult foreigner who, as a beneficiary of the holder of a resident’s visa who demonstrates his/her activity or source of income and has lived in national territory for a minimum of five (5) continuous, uninterrupted years at the time of applying for a visa.
- Any foreigner who has held a temporary visa as spouse or permanent partner of a Colombian national for a continuous, uninterrupted term of a minimum of three (3) years,
Exceptions: Holders of courtesy, business, crew members' and temporary visitors' visas in the special category for medical treatment, to participate in administrative or judicial proceedings, as a cooperator or volunteer of the non-profit entity or non-governmental organization (NGO) and for adoption procedures.
The safe conduct issued by the Special Colombia Migration Administrative Unit referred to in 80.2.1 of article 80 of Decree 4000 of 2004, will be taken into account to calculate the terms established in this article.
COSTS
*Payment for the study is not refundable and will be valid only on the day on which payment is made; to present a new visa application, a new fee will be payable..
General Requirements:
- Presentation of visa application form DP-FO-67, completely filled out and signed by the foreign applicant and not by an intermediary.
- Valid passport or travel document, in good condition, with a minimum of two blank pages.
- Three (3) recent 3x3 cm identical full face photographs, in color and against a white background.
- Copy of the biographical details page of the passport and of the page showing the most recent Colombian visa, if any, and stamp of arrival in or departure from Colombia, as appropriate.
Specific Requirements
FOR A FOREIGNER WHO IS THE FATHER OR MOTHER OF A COLOMBIAN NATIONAL:
In addition to the general requirements, the applicant must present:
- Form DP-FO-66 “commitment to report change of occupation”, which must be signed directly by the foreign applicant. (If the application for a visa is made through a proxy or third person, the signature must be authenticated by a Colombian notary, unless presented personally by the applicant.)
- Copy of the Civil Birth certificate of the Colombian son or daughter.
- Letter signed by the Colombian father or mother requesting the visa for the foreigner in person before a Colombian public notary or consul declaring that he/she will be economic responsible for the son or daughter. If the latter is of age, it may be signed by him/her, also with personal presentation before a Colombian Notary or consul.
- In the event of the death of the Colombian father or mother, the death certificate may be presented together with the certification of guardianship of the son or daughter in the case of a minor.
- In exceptional, fully justified cases, the letter of the Colombian father or mother may be replaced by a certification of the competent Colombian family authority responsible for the welfare of the respective Colombian minor specifying that the foreigner has fully complied with his/her alimony or other obligations, as appropriate.
- Photocopy of the identity card of the father or mother of the Colombian national and of the Colombian adult son or daughter.
- In the event that both parents are foreign, in addition to the requirements referred to above, they must present a letter signed by the foreign holder of a Resident's Visa, father or mother of the minor born in Colombia, together with a photocopy of the identity card, requesting the issue of a Visa in this category and stating who is economically responsible for the son or daughter. A copy of the Qualified Visa valid at the time of birth of the minor and the migration.
NOTE: A foreigner who is resident as a family member of a Colombian national will be authorized for the occupations of: CARE OF THE HOME AND/OR STUDENT / INDEPENDENT AND/OR TO BE CONTRACTED, following prior fulfillment of the respective regulations.
In the case of a regulated profession, foreigners must present the documents permitting him/her to practice that profession, as well as those of the equivalence or validation of the professional qualification, provisional permit, license to practice or registration or professional card.
- Documents issued abroad must have an apostille or be legalized by a Colombian consul, as appropriate.
- Any document in a language other than Spanish must be officially translated into Spanish and the translator's signature must be duly legalized or with an apostille.
ANY FOREIGNER WHO HAS BEEN A HOLDER OF A TEMPORARY VISA FOR FIVE (5) CONTINUOUS, UNINTERRUPTED YEARS (continuity in time):
In addition to the general requirements, the applicant must present:
- Copies of the temporary visas showing certifying the five (5) uninterrupted continuous years in Colombia.
- Certificate of migration issued by the Special Colombia Migration Administrative Unit attached to the Ministry of Foreign Affairs, within the three (3) months prior to the date of the visa application in a completely closed envelope.
- Form DP-FO-66 “commitment to report any change of occupation”, duly filled out. This must be signed directly by the foreign applicant. (If the visa application is through a proxy or the person, the signature must be authenticated by a Colombian notary or before the respective Colombian consulate, except when personally presented by the applicant.)
FOR A FOREIGN HOLDER OF THE TEMPORARY VISA AS THE SPOUSE OR PERMANENT PARTNER OF A COLOMBIAN NATIONAL:
In addition to the general requirements, the applicant must present:
- Copies of the temporary visas showing the three (3) uninterrupted, continuous presence in Colombia.
- Letter signed by the Colombian spouse, if appropriate, requesting the visa for the foreigner personally to a Colombian notary public or consul, declaring that he/she will be responsible for the foreigner during his/her presence in Colombia.
- Photocopy of the identity card of the Colombian national spouse.
- Certificate of migration issued by the Special Colombia Migration Administrative Unit attached to the Ministry of Foreign Affairs, within the three (3) months prior to the date of the visa application.
- Present Form DP-FO-66 “commitment to report change of occupation", which must be signed directly by the foreign applicant. (If the visa application is through a proxy or the person, the signature must be authenticated by a Colombian notary or before the respective Colombian consulate, except when personally presented by the applicant.)
- Civil registration of the Colombian marriage or a photocopy of the legal decision, minute of conciliation or the public deed declaring the existence of a de facto marriage, as appropriate. All such documents must have been issued within the three (3) months prior to the visa application.
NOTE: This Visa will authorize any foreign resident for the following occupations: CARE OF THE HOME AND/OR STUDENT / INDEPENDENT AND/OR TO BE CONTRACTED, following prior fulfillment of the respective regulations.
