TEMPORARY - WORKER
Art. 30 of Decree 4000 of 2004
First temporary visas must be applied for at a Colombian consulate.
DURATION: Duration up to two (2) years. It will be canceled in the event of absence from Colombian territory exceeding one hundred and eighty (180) days. It authorizes entry and remaining in Colombia for any foreign person wishing to do so and who fulfills one or several of the following conditions:
- A foreigner contracted by a company, entity or institution, either public or private, or a natural person wishing to enter and remain in this country to engage in work or activity in his/her specialty or to provide technical training.
- A foreigner wishing to enter and remain in Colombia under academic agreements between higher education institutions or inter-administrative agreements in specialized areas. He/she must provide proof of his/her suitability by presenting the respective duly validated qualification, or certificates of he/she is not a professional.
- A foreign journalist contracted by a news or national or international information agency, or who is a correspondent, due proof of which must be presented.
- A foreigner belonging to an artistic, sports or cultural group contracted for his/her activity when it is remunerated.
- A foreigner appointed by a State body or entity.
- Executives, technicians and administrative staff of a public or private foreign entity, either commercial or industrial, transferred from abroad to fill specific positions in their companies.
- Volunteers and missionaries who do not belong to the hierarchy of a church, confession, religious denomination, federation, confederation or association of religious ministers.
- A foreigner who, without a work relationship with any company domiciled in Colombia, provides his/her services in the implementation of specific projects, is requested by companies with domicile in Colombian territory.
*Payment for the study is not refundable and will be valid only on the day on which payment is made; to present a new visa application, a new fee will be payable.
General Requirements:
- Presentation of visa application form DP-FO-67 , completely filled out and signed by the foreign applicant and not by an intermediary.
- Valid passport or travel document, in good condition, with a minimum of two blank pages.
- Three (3) recent 3x3 cm identical full face photographs, in color and against a white background.
- Copy of the biographical details page of the passport and of the page showing the most recent Colombian visa, if any, and stamp of arrival in or departure from Colombia, as appropriate.
Specific Requirements
In addition to the general requirements, the following must be attached:
- Contract or administrative certificate or Form DP-FO-68 of “Summary of contract” established in article 29 of Resolution 4700 of November 25, 2009, filled out, signed personally at a Notary and/or before a Colombian consul by the parties, stating the purpose of the contract, its term of duration, membership agreement, contract, transfer, as appropriate, salary, position and duties, and specify that the contracting party or employer undertakes before the national Government, on termination of the contract, relationship or transfer period, or in situations which prevent him/her from performing the duties or activities under the contract, or death, or when cancellation of the respective visa, deportation or expulsion is required, as established in Decree 4000 of 2004, to pay all the expenses for return to his/her country of origin or to the last place in which the residence of foreigner contracted is evidenced, as well as his/her family, if appropriate.
- Certificate of existence and legal representation or valid document certifying legal corporate existence, as the case may be, when the contracting party or employer is a legal person, issued within the three (3) months prior to the visa application. When considered necessary, the company's balance sheet showing its economic solvency or a photocopy of its income tax return will be requested.
- When the contracting party is a natural person, he/she must provide proof of his/her economic solvency, having an income exceeding 10 minimum legal monthly wages in force, and, if necessary, a photocopy of his/her income tax return for the last tax year will be requested. According to the provisions of Resolution 4700 of November 25, 2009, article 10, inset 2, it is established that these documents will not be required of Colombian State bodies, entities or institutions, international governmental organizations, diplomatic missions or consulates accredited in this country.
- Certification of suitability in the case of a regulated profession practiced under the corresponding permit, license or provisional permit to do so in Colombia, granted by the competent authority, as appropriate. In the case of the practice of a non-regulated profession or activity, the professional qualification, duly authenticated by the Colombian consulate, legalized or with an apostille and/or validation of the professional qualification before the Ministry of Education, as appropriate, must be presented. For other positions, a letter of the responsible contracting entity or employer, certifying suitability on the basis of experience in the work or activity to be performed in Colombia.
- Documents issued abroad must have an apostille or be legalized by a Colombian consul, as appropriate.
- Any document in a language other than Spanish must be officially translated into Spanish and the translator's signature must be duly legalized or with an apostille.
