BUSINESS

Article 23 of Decree 4000 of 2004.

Up to four (4) years for multiple entries. It will be cancelled in the event of remaining for more than one (1) continuous year in Colombian territory; it is granted to any foreigner who meets one or several of the following conditions:

1.    Is a legal representative, director, manager or executive of a foreign commercial, industrial or service company or one which has an economic relationship with a national or foreign company established in Colombian territory and is able to carry out activities inherent in the entrepreneurial activities involving the interests he/she represents, such as attending partners’ meetings, business trips, providing consultancy in market research or supervising the management of companies with which he/she has a legal, strategic or economic relationship.

2.    Accredits his/her situation as a trader, industrialist, supplier of goods and services or who is visiting businesses with a view to entering Colombia for those purposes, or to carry out market research or hold negotiations for future sales and/or establish a commercial presence in this country.

3.    Wishes to enter national territory and live here temporarily as a business person within the framework of a free trade or association agreement or of any other international commitment of which Colombia is a party. Likewise, in these cases, a Business Visa may be issued to a foreigner for a business visit, a national of the State which is a party under the respective agreement who wishes to enter Colombia in order to undertake entrepreneurial administrative activities; to promote business, make investments, establish the commercial presence of a company, promote cross-border trade in goods and services or other activities defined in such agreements.

•         The duration of the Business Visa referred to in this numeral will be for up to four (4) years for multiple entries and departures and authorizes the business person to remain in Colombian territory for up to two (2) continuous years for each entry. The duration of this Visa will terminate if the foreigner exceeds the duration of two (2) continuous years of authorized presence in this country. These terms will be granted when the State of the nationality of the holder of the visa grants equivalent authorizations to enter and remain in its territory to holders of an ordinary Colombian passport who also fulfill the same conditions as those described in this numeral.

4.    Wishes to enter national territory and remain here temporarily as the head, representative or member of a governmental foreign trade office staff who promote economic or commercial exchanges in or with Colombia.

•    The duration of the Business Visa referred to in this numeral will be for up to four (4) years for multiple entries and authorizes a continuous term in Colombian territory for the same period.

COSTS

*Payment for the study is not refundable and will be valid only on the day on which payment is made; to present a new visa application, a new fee will be payable.

General Requirements:

1.    Presentation of  visa application form DP-FO-67 , completely filled out and signed by the foreign applicant and not by an intermediary.

2.    Valid passport or travel document, in good condition, with a minimum of two blank pages.

3.    Three (3) recent 3x3 cm identical full face photographs, in color and against a white background.

4.    Copy of the biographical details page of the passport and of the page showing the most recent Colombian visa, if any, and stamp of arrival in or departure from Colombia, as appropriate.

Specific Requirements

In addition to the general requirements, one of the documents referred to in any of the following numerals, according to the respective interest in entering Colombia:

1.    Letter from the legal representative of the foreign commercial, industrial or services company sponsoring the visit of the foreigner to Colombia stating the position of the Business Visa applicant in the organization, which must be at the level of director, manager, executive or legal representative, as well as the entrepreneurial management activities which he/she is to perform in Colombia, the legal, strategic or economic relationship of the foreign legal person with a national or foreign legal person established in Colombian territory, if any, and that the foreign company or legal person will be responsible for him/her during his/her time in Colombia, attaching the certification of incorporation, legal representation or similar document of his/her country of origin.

2.    Letter from the legal representative of the legal person or public, private or mixed entity in the country promoting the foreigner's visit, stating the position which the Business Visa applicant is to hold in the organization, which must be at the level of a director, manager, executive or legal representative; the entrepreneurial activities which he/she is to perform in Colombia and declaring that it assumes responsibility for him/her during his/her presence in this country, together with the respective certification of incorporation and legal representation.

3.    Letter of invitation addressed to the foreign Business Visa applicant from a company or legal person established in Colombia, stating the activities which the business person is to perform in this country and that it assumes responsibility for him/her during his/her stay in this country, together with the respective certification of incorporation and legal representation.

4.    Letter of invitation and/or presentation of the foreign Business Visa applicant from a Chamber of Commerce or governmental commercial promotion or investment office of his/her country of origin or of residence, stating the activities that the business person is to perform in this country.

5.    When the Business Visa application is made on the basis of a free trade or association agreement or another economic or commercial international agreement of which Colombia is a party, the applicant must provide proof of fulfillment of the conditions and requirements for entry and temporary presence agreed upon in the respective international instrument and present the documentation describing the activity which the foreigner is to carry out in Colombia or the documents described above in numerals 1, 2 or 3.

6.    Letter of introduction of the Business Visa applicant as head, representative or member of the staff of the foreign governmental Commercial Office established in Colombia which promotes economic or commercial exchanges in all with Colombia.

7.    When any circumstance not included in the foregoing numerals exists, the applicant for the Business Visa will be responsible for providing proof, in the relevant documentation, of his/her commercial, industrial, goods or services provider status or his/her intention to carry out market research, negotiations of future sales or the establishment of his/her commercial presence in this country.

- Documents issued abroad must have an apostille or be legalized before the Colombian Consul, as the case may be.

- Any document in a language other than Spanish must be officially translated into Spanish and the translator’s signature must be duly legalized or with an apostille.
